New creditworthiness assessment guidance

Compliance
9.4.2021

The Danish FSA and the Consumer Ombudsman have just published the new guidance on creditworthiness assessment.

The guidance is intended to help creditors comply with Sections 7c and 9 of the Danish Credit Agreement Act on consumer lending, according to which creditors are obliged to carry out a creditworthiness assessment to avoid providing irresponsible credit.

The guidance is relevant to all creditors, but it is particularly appropriate for account information service providers (AISPs). The guidance clarifies that bank transaction data can be included as part of the creditworthiness assessment basis on an equal footing with other information on the financial circumstances of loan applicants.

CO:PLAY has contributed to the submission of consultation responses before the publication of the guide.
