In a knowledge society, the company's employees are the most important resource.

In Denmark, there is extensive regulation of employees, and this is the single legal area where the most agreements are made, which at the same time contains a large number of requirements for the content. It is also a jurisdiction where there are (too) many disputes.

CO:PLAY's team has solid experience in advising on organisation, including the conclusion of agreements which, on the one hand, create motivation and transparency and, on the other hand, can prevent the emergence of disputes.

Employment

CO:PLAY advises on all aspects of employment and labor law, including in particular the contractual basis between employer and employee, whether they are directors, salaried employees or hourly wage earners.

Incentive programmes and bonus schemes

Incentive programmes will typically be share-based (i.e. based on equity participations in limited liability companies), whereby the basic incentive lies in the increased value of the company. From a legislative perspective, it has been desired on the one hand, to create a favourable tax regime in relation to share-based incentive programmes and, on the other hand, to ensure that employees are protected and, in particular, informed.

Incentive programmes will typically be based on warrants and will consequently also require compliance with a number of corporate law requirements.

Share-based incentive programmes thus require coordination and coherence between tax rules, labour law rules and company law rules.

CO:PLAY can advise on all the legal aspects of incentive programmes, including tax. We have developed a number of fixed-price packages that, despite the complexity, make it easy to implement incentive programs.
